not really, maybe a little and yes.

^ Were those answers in order?
I come up with Maybe, Maybe, and Yes&No.
Would it affect the performance of the car? Maybe. "They" say that an EGR valve can help to keep combustion chamber temperatures a little lower (yes, even though you're entering hot exhaust gases).
Does it need the EGR? Maybe, if your car gets a visual inspection when it gets emissions tested.
Does it need the AIR holes/pump? Yes, if it gets a visual inspection.
& No because the air pump injects air into the exhaust to keep the emissions level lower while the engine is getting up to running temperature, not after.
But since your car is OBD II, you can throw some of those variables out the window. Your car will get a plug & play test, not a sniffer test. So they'll be checking for error codes through the OBD port, and to make sure you have emissions equipment on the engine.
If your original EGR valve has an electrical hookup, then not having it plugged in will throw an error code. An AIR pump that isn't hooked up through the hoses to the exhaust won't throw a code, but it will throw a code if the electrical connection to it is unplugged.

If you live in California you need everything. Emissions are ridiculous there. They will not allow you to run a long tube header and pass emissions, you fail the visual. You need a 50-state legal emissions header with a CARB number.
