Why are you still talking about lost title. This guy wants to seize a car that is not and has never been in his name. I have been through the process. Its the bad side of being a mechanic. When you repair a car and the person does not want to pay for the repair you put a lien on the car. You have to hold the car until the cost of repair + storage is equal to or greater than the value of the car. Then you can apply for a new title from the State. The State will attempt to contact the title owner for about 6 months. If the owner response and agrees then it will move quickly. If the own tosses inquires in the garbage or can not be found it will end up taking a year. Have you been through the process in your State? Not a lost title, seizing a car is what we are talking about.

The process is same for storage and towing companies.

We had a classic MG we where almost done with and the owner just stopped calling or checking on it. We where half way through the waiting period when a rather large group of people showed up. Turns out the owner had died and no one knew where the car was until the State informed them of our request for title. They paid the bill and the former owner son drove it off the lot. I am not sure what Law NH has but if they do not have something like that it is just wrong. Heck even WV had similar laws.

Aggg
NH is faster but they make you do all the crap. They require a certified letter receipt after you got the lien. I did not see what you need to do if the certified letter is returned to sender. They do have a nice system if the car is worth less then $1000.

Mechanic’s Lien Requirements- Pursuant to RSA:450, a person purchasing a motor vehicle or trailer at a lienholder’s public sale for satisfaction of a lien for storage or labor, shall submit the following documentation to the Division of Motor Vehicles in order to obtain a certificate of title:
A. TDMV 23: A properly executed Title Application prepared by a town or city clerk or by a New Hampshire licensed dealer.
B. TDMV 22A: A bill of sale from the lienholder/mechanic or storage facility
C. TDMV 108: An affidavit of sale, from the lienholder describing the vehicle by make, model, year, body style, and vehicle identification number and containing the following listed information:
1. The amount of the lien and the amount of time the lien has remained unpaid.
2. The date and the two public places where the Notice of Public Sale was posted.
3. The date and name of the newspaper that published the notice of public sale.
52
4. The date a written inquiry was sent by verified mail, return receipt requested, to the Division of Motor Vehicles to determine whether a lien exists upon the title to said motor vehicle.
5. The names of the lienholder having a recorded lien on the vehicle (if any).
6. The date the verified mail was sent, return receipt requested, to the owner and the lienholder(s) (if any), notifying them of the time and place of the sale and the amount of the lien.
D. TDMV 19A: Verification of Vehicle Identification Number.
E. Appropriate fee.
